J ust as no two houses are exactly the same, neither are the homeowners who live there. For example, while one resident may never plan to move, another may want to sell in the next six months. While one may have the resources to make all the energy-efficient improve-ments to the house at once, another may have to make selective upgrades over time. And either approach is fine with Hal Smith, co-owner, Halco Energy, Phelps, N.Y., who stated that this situation illustrates the beauty of home-performance contracting (HPC). “It gives you the ability to solve homeowners’ com-fort and efficiency issues and really focus on doing what is best for them within their budget.” List of Priorities The budget is often the sticking point for homeowners, which is why some contractors are more successful when they offer a staged approach to HPC. (Photo courtesy of Comfort Institute) Continued on page 4 Congress Unlikely to Renew HVAC Tax Provisions in 2013 25C, 179D, Other HVAC-Related Tax Provisions Set to Expire on Dec. 31 By Jen Anesi Of The NEWS Staff S everal tax provisions impacting the HVAC industry, including 25C, the expanded Section 179 expensing allowances, and the 179D Commer-cial Building Tax Deduction, are set to expire on Dec. 31, 2013. And although industry lead-ers agree that the provisions will probably be renewed, they also agree that it is unlikely to occur in 2013. That would again put some manufacturers, distributors, and contractors in limbo as they wait to receive word that the tax incentives are once again available. Now You See It, Now You Don’t The lengthy list of about 65 tax provi-sions that are expiring is the same list every year or two, said Charlie McCrudden, senior vice president of government relations for Air Conditioning Contractors of America (ACCA). “Congress passes these extender packages and then sits around until they get close to expiring again before they debate whether they’re necessary or effective provi-sions. They usually keep almost all in place.” “Congress has discovered it can retroactively pass tax incentives,” said Guido Zucconi, assis-tant vice president of congressional affairs for the Air-Conditioning, Heating, and Refrigera-tion Institute (AHRI). “I don’t see them doing anything before the end of the calendar year, especially with the budget battles. Maybe in late winter or early spring they’ll get around to taxes. If you’re trying to incentivize someone to upgrade his home, this is ineffective.” Section 25C, the Residential Energy Effi-ciency Tax Credit, was reinstated retroactively for 2012 on Jan. 1, 2013, as part of the fiscal cliff deal.
